The Telangana government is actively working to commence the panchayat election process before the High Court’s September 30 deadline. This initiative aims to ensure the implementation of a 42% reservation for Backward Classes (BCs) in local body elections, as mandated by recent legislative actions.

High Court’s Directive and Government’s Response

On June 25, the Telangana High Court directed the State Election Commission (SEC) to complete the panchayat election process within three months, ensuring compliance with caste based reservations. In response, the state government has been taking steps to meet this deadline. A recent high level meeting, chaired by Chief Minister A. Revanth Reddy, discussed initiating the election process before September 30. While holding the polls by the deadline may not be feasible, the government is committed to at least commencing the process. Two options are under consideration: initiating the election process before the deadline or seeking a legal extension from the High Court while presenting the steps already taken toward compliance.

Legislative Actions for BC Reservations

To facilitate the 42% BC reservation, the Telangana Assembly passed two bills amending the Panchayat Raj Act and the Municipalities Act. These amendments aim to lift the existing 50% ceiling on overall reservations, allowing for the enhanced BC quota. However, these bills are pending assent from the President of India and the Governor of Telangana. In the interim, the government issued an ordinance to implement the increased BC reservation, but this too awaits approval.

Preparations for Election Process

Despite the pending legislation, the SEC has been preparing for the elections. Electoral rolls have been finalized, polling stations identified, and logistics organized. However, the finalization of reservations is the last administrative step before the election schedule can be formally released. The SEC plans to convene an all party meeting to ensure that there is no delay in conducting the elections once the BC reservations are approved.

Legal Considerations and Future Steps

The government is closely monitoring the progress of the pending bills and the ordinance. If the required approvals are not obtained in time, the government may seek an extension from the High Court. Legal experts are advising on the best course of action to ensure compliance with the High Court’s directive while upholding the constitutional validity of the BC reservations.
