New Delhi: The Supreme Court of India is set to hear a series of petitions on November 5 concerning the extension of deadlines for Waqf property registration under the Waqf (Amendment) Rules, 2024. The petitions, filed by several Waqf Boards and community organizations, seek relief from the earlier notification that mandated all unregistered Waqf properties to be recorded within a specific time frame.

Background of the Case

The Ministry of Minority Affairs had issued a directive in early 2024 instructing all State Waqf Boards to complete the digitization and re-verification of Waqf properties under the Central Waqf Management System of India (WAMSI).
However, several State Boards, including those from Telangana, Uttar Pradesh, Maharashtra and West Bengal, sought additional time, citing technical difficulties, missing land records, and ongoing disputes over ownership.

Petitioners Argument

The petitioners argue that the original timeline was too short and imposed undue pressure on the boards that handle thousands of properties. Many Waqf lands are under litigation, encroached upon, or lack proper documentation due to decades old inheritance and endowment issues.
They further emphasized that the Waqf Board’s administrative staff and digitization systems are not adequately equipped to complete the task without government assistance.

Centre’s Stand

The Union Government, represented by the Ministry of Minority Affairs, has maintained that the registration and digital mapping are essential for transparency, accountability and prevention of encroachments. Officials have stated that any further delay could affect future development plans linked to public welfare projects under the Central Waqf Development Scheme.

Community Response

Waqf management committees and several religious leaders have welcomed the Supreme Court’s decision to take up the matter urgently. Many have urged the government to consider the ground realities, especially for smaller states and minority managed charitable trusts that lack sufficient resources.

Expected Outcome

The hearing on November 5 is expected to address:

  • Whether the registration deadline will be extended.
  • The extent of flexibility to be given to State Waqf Boards.
  • Possible formation of a central monitoring committee to oversee compliance.

Legal experts say the verdict will have a Nationwide impact, as over 8 lakh Waqf properties are under review across India.
