Nizamabad Encounter Raises Questions Over Police Use of Force and Institutional Transparency

The killing of accused Shaik Riyaz at the Nizamabad Government General Hospital has sparked demands for detailed investigation and departmental accountability, as concerns grow over the circumstances of what the police have termed an “encounter”.

Sequence of Events

  • Riyaz, 24, was arrested on October 19 in connection with the murder of constable E Pramod Kumar who was allegedly stabbed during an escort duty in Nizamabad.
  • On the morning of October 21, while under treatment in hospital, Riyaz is reported to have attempted to snatch a service firearm from an armed reserve constable posted for his security. The police claim they opened fire in “private defence”, leading to Riyaz’s death on the spot.
  • However, conflicting reports have emerged. The local police initially asserted that Riyaz was caught alive, while other accounts described the incident as a police encounter. This discrepancy has triggered scrutiny.

Institutional Response & Accountability

  • The Telangana State Human Rights Commission (TSHRC) has taken suo motu cognisance of the incident and directed the state DGP B. Shivadhar Reddy to submit a comprehensive factual report. The Commission has asked for the FIR, autopsy report, details of any judicial or magisterial inquiry and proof of compliance with the guidelines laid down by the National Human Rights Commission (NHRC) and the Supreme Court of India on encounter deaths.
  • The High Court of Telangana also declined to take an urgent hearing request on the matter but directed that procedures should be followed, adding another layer of legal monitoring.
  • Meanwhile, the police department has defended its actions, citing the suspect’s alleged attempt to grab a firearm and fire at officers and patients. The DGP announced a ₹1 crore ex-gratia package for the slain constable’s family and confirmed that an investigation team has been formed.
