Delhi Court Refuses to Order FIR Against Minister Kapil Mishra

A court in Delhi has declined to order the registration of a First Information Report (FIR) against minister Kapil Mishra in connection with a complaint seeking legal action over alleged remarks linked to past communal tensions.

The petition was filed by a complainant who requested the court to direct police to register an FIR and initiate an investigation against the minister. The plea was related to statements made during the period of unrest in parts of the national capital in 2020.

After reviewing the arguments and available records, the court ruled that there was insufficient ground to order an FIR at this stage. The judge observed that the matter did not require immediate police investigation based on the material presented before the court.

The court also noted that the complainant had the option of pursuing other legal remedies under criminal law if additional evidence or grounds were available.

Delhi Police had earlier submitted its response during the proceedings, stating that the available evidence did not justify registration of a criminal case in the matter.

The decision comes amid continuing legal and political debates related to statements made during the violence that occurred in parts of Delhi in 2020. Several cases linked to the unrest have been heard in courts over the past few years.

Legal experts say the court’s order means that no FIR will be registered against Kapil Mishra based on this particular complaint, unless a higher court issues a different direction or new evidence emerges.
