A fact finding committee has demanded that a full inquiry be conducted by the Central Bureau of Investigation (CBI) into the killing of Shaik Riyaz while in police custody. The Telangana State Human Rights Commission (TGHRC) has flagged the incident and questioned whether the legal norms governing custody and use of force were followed.
What Happened
According to police, Shaik Riyaz accused in the fatal stabbing of Constable M. Pramod Kumar was shot dead during an “exchange of fire” with police inside the Nizamabad Government Hospital after allegedly attempting to snatch a firearm from a constable while under guard.
However, the deceased’s family and human rights activists dispute the official version, claiming Riyaz was injured, in custody and possibly subjected to torture before being shot in what they call a “fake encounter” inside the hospital.
Why a CBI Inquiry Is Being Demanded
- Several major concerns have prompted the demand for an independent federal investigation:
- The incident occurred while Riyaz was in custody, raising questions under Article 21 of the Constitution (right to life) and national guidelines on encounter deaths.
- The family alleges procedural violations inadequate escorting, lack of CCTV footage, and possible third degree treatment.
- Activists say only a central agency like the CBI can ensure impartiality, given the involvement of local police and serious rights implications.
What the Authorities Have Done So Far
- The Telangana State Human Rights Commission (TGHRC) has taken suo motu cognisance of the incident and directed the DGP to submit a detailed factual report covering the FIR, post mortem report, custody records, and inquiry details by 24 November.
- The Telangana High Court declined an urgent hearing on the matter and told petitioners to follow prescribed registry procedures.
- The police maintain the official version of events and have stated support to the slain constable’s family. The case remains under internal investigation.
